What is the Appeals Process in Alabama?
An appeal is a process through which a party may challenge a trial court’s ruling by appealing the case to the appellate court. This occurs when a party is unhappy with the trial court’s final order, the individual looking for an appeal has 6 weeks following the court’s decision and must file the paperwork with 42 days.
The appeals process is as follows:
- A Notice of Appeal must be filed with the clerk of the trial court
- A ARAP-1C form must be submitted to reveal the court's transcript for the case as the content will be imperative to making your appeals case
- The Court of Criminal Appeals Docking Statement will allow you to submit your appeals case to the court with a brief description as to why your case is under review
