What is Divorce Process in Alabama?
A divorce is a legal proceeding through which a marriage is legally dissolved. Often times, divorce cases are ultimately resolved through the execution of a marital settlement agreement. However, if a case cannot be resolved, a court will determine the outcome after a full trial on the merits. We believe that no two families are exactly alike, and therefore no two divorce cases are exactly alike, and we strive to treat your divorce with the attention to detail it deserves. Divorces may range from an uncontested divorce with no children or assets, to a high asset case with children and complex legal issues.
Through the divorce process, the following issues may be handled:
- Custody of children and visitation
- Child support
- Division of assets, including but not limited to real property, personal property, financial accounts and the like
- Division of debt
- Division of retirement benefits, including those divisible by a Qualified Domestic Relations Order
- Alimony
What is a Legal Separation?
A legal separation is a process through which a couple desires to live separately but choose to remain legally married. This involves an agreement or court order which defines the parties respective rights and responsibilities with regards to their children, support obligations, assets, debts and other matters, and sets forth the terms under which the parties will live moving forward.
Same-Sex (LGBTQ/Gay) Marriage Laws in Alabama
As Alabama now recognizes same-sex marriage, not only do same-sex couples have the same rights as all other couples, but they also face the same legal challenges when it becomes apparent their marriage is no longer sustainable. We believe that no matter the circumstances, the dissolution of any marriage should be handled with the attention it deserves.
